The list of grounds for terminating an employment contract with a foreign national has been expanded
Amendments have been made to Article 327.6 of the Russian Labor Code, under which employers will be able to dismiss foreign nationals and stateless persons in order to bring the number of such employees into line with the restrictions established by regional regulations.
The Labor Code of the Russian Federation provided for the possibility of terminating an employment contract with a foreign national only when restrictions were established at the federal level. Decisions by regional authorities have now been added as grounds for termination.
Employers will be able to terminate employment contracts with foreign nationals if a constituent entity of the Russian Federation has introduced restrictions on the type of work a foreign national may perform.
The employment contract must be terminated no later than the end of the period established by the regulatory legal act of the constituent entity of the Russian Federation (Article 1 of the law).
Since 2015, constituent entities of the Russian Federation have had the right to establish annual restrictions on the hiring of foreign workers who arrive in Russia without a visa and work under a patent in certain types of economic activity.
In a number of constituent entities of the Russian Federation, foreign nationals are prohibited from working in certain types of economic activity.
The law entered into force on March 1, 2026.
