Residence permit for a foreign citizen recognized as legally incapacitated or with limited legal capacity
The right to submit an application and a package of documents for a residence permit (hereinafter referred to as a residence permit) in the Russian Federation without first obtaining a temporary residence permit also applies to the following categories of foreign citizens:
Thus, a foreign citizen who is legally incapacitated or has limited legal capacity may obtain a residence permit if their legal representative (parent, adoptive parent, guardian, or trustee) either already holds a residence permit in the Russian Federation or is applying to obtain one. The application for a residence permit for the person under guardianship is submitted by their representative either at the same time as the representative's own application for a residence permit or after the representative has obtained one.
Practical examples:
An Estonian citizen holding a residence permit in Russia may apply for a residence permit for their legally incapacitated ward, bypassing the stage of obtaining a temporary residence permit (TRP).
A family of Lithuanian citizens, including an adult child judicially declared legally incapacitated, moves to Russia. When applying for residence permits for themselves, the parents, as guardians, may also submit an application for a residence permit for their legally incapacitated child at the same time.
Document submission procedure: To obtain a residence permit pursuant to subparagraphs 5 and 6 of paragraph 2 of Article 8 of Federal Law No. 115-FZ of 25.07.2002 “On the Legal Status of Foreign Citizens in the Russian Federation”, the legal representative of a foreign citizen who is legally incapacitated must apply to the territorial office of the Main Directorate for Migration Affairs of the Ministry of Internal Affairs of Russia at the place of stay.
